Terms + Conditions

These Terms & Conditions apply to all services, products, and commissions provided by Gabrielle Rose Art, including but not limited to live event painting, bespoke stationery, custom illustrations, and related creative services.
By booking, purchasing, or commissioning work, you agree to the terms outlined below.
Booking & Payment
A non-refundable retainer or deposit is required to secure all bookings and reserve studio or event dates.
No work will begin until the initial payment has been received.
Remaining balances are due according to the invoice or agreed payment schedule and must be paid in full prior to final delivery or event execution, unless otherwise stated in writing.
All payments are processed through trusted third-party providers, including Square, Venmo Business, and PayPal. By submitting payment, you agree to the terms and privacy policies of these providers.
Gabrielle Rose Art does not collect, store, or have access to full payment or banking details.
Cancellations, Refunds & Rescheduling
All deposits and retainers are non-refundable and non-transferable.
If a project is canceled after work has begun, payment is still required for all work completed, time reserved, and materials used up to the cancellation date.
Rescheduling requests will be accommodated based on availability but cannot be guaranteed. If a new date cannot be secured, the original agreement remains valid under these terms.
Production Timelines & Client Responsibility
All timelines are determined at the time of booking based on project scope, event date, and availability.
Timelines are dependent on receipt of complete and accurate client information, including but not limited to:
Design and production will not begin until all required information has been received in full.
Gabrielle Rose Art cannot be held responsible for delays caused by missing, incomplete, or late client submissions.
Rush or expedited timelines may be available at the artist’s discretion and may include additional fees.
Artistic Direction & Style
All work is created in Gabrielle Rose Art’s signature style, which includes watercolor and mixed media illustration.
By commissioning work, you acknowledge that:
Artistic interpretation and composition remain with the artist
Final artwork is a creative interpretation and may not be a direct photographic replica
The artist retains full creative discretion necessary to complete the work
This ensures consistency and integrity across all artwork.
Design, Proofing & Revisions
For stationery and custom design work, up to three digital proofs are included unless otherwise stated.
Two rounds of revisions are included for applicable stationery and design services. Additional revisions may be requested at $50 per round.
It is the client’s responsibility to carefully review all proofs for accuracy, including spelling, names, dates, and layout details.
Once a proof has been approved for print or final production, no further changes may be made. Gabrielle Rose Art is not responsible for errors approved by the client.
Live Event Services
For live painting and event-based services, the client is responsible for ensuring:
appropriate venue space, lighting, and working conditions
access to guests or subject matter during the event
confirmed event details and guest counts prior to the event date
Completion of artwork depends on event timing, flow, and conditions. Any unfinished elements may be completed in-studio at the artist’s discretion.
Bespoke Stationery & Custom Work
Bespoke stationery and illustrated pieces are created based on client-provided information and agreed project scope.
Clients are responsible for providing accurate and clearly labeled reference materials, including names and images when applicable.
All work follows a defined review and approval process prior to final production.
Pricing & Taxes
All pricing is listed in U.S. dollars.
Applicable sales tax will be collected where required by law.
Prices are subject to change at any time; however, confirmed bookings will not be affected once payment has been received.
Quantity Changes & Scope Adjustments
Any changes to quantity or project scope after booking will require a new invoice and may affect production timelines.
Materials & Availability
Paper stocks, envelopes, and specialty materials are subject to availability.
Substitutions may be required if selected materials are unavailable. Any cost differences will be communicated prior to production when applicable.
Shipping & Delivery
All physical items are shipped via third-party carriers.
Once an order has been shipped, Gabrielle Rose Art is not responsible for delays, loss, or damage during transit.
Tracking information will be provided upon shipment. Delivery timelines are managed by the carrier and are outside of the artist’s control.
Returns & Final Sale
All work is made to order and is final sale.
No refunds, returns, or exchanges are offered for custom work, printed goods, or event-based services.
Refunds will not be issued for color variation, material selection, or client preference once proof approval has been given.
Intellectual Property & Copyright
All artwork, designs, illustrations, and creative content produced by Gabrielle Rose Art remain the intellectual property of Gabrielle Rose Art unless otherwise agreed in writing.
This includes all concepts, sketches, proofs, and final artwork.
Unless otherwise agreed:
Gabrielle Rose Art retains full copyright
Artwork may be used for portfolio, marketing, and promotional purposes
Clients receive personal or event usage rights only
Artwork may not be reproduced, resold, or altered without written permission
All work is protected under U.S. copyright law upon creation.
Third-Party Services
Gabrielle Rose Art works with trusted third-party providers to operate the business, including but not limited to payment processors, website platforms, analytics tools, email marketing services, and shipping carriers.
These providers are responsible for their own privacy and data handling practices.
Limitation of Liability
To the fullest extent permitted by law, Gabrielle Rose Art is not liable for any indirect, incidental, or consequential damages arising from services, products, third-party platforms, or shipping providers.
Total liability is limited to the amount paid for the specific service or product in question.
Portfolio & Promotional Use
Unless otherwise agreed in writing prior to the event or project, Gabrielle Rose Art, LLC reserves the right to photograph, scan, reproduce, publish, and display any artwork, illustrations, stationery, or other creative works produced for a client for portfolio, marketing, advertising, educational, editorial, competition, exhibition, and promotional purposes. This includes, but is not limited to, use on the company's website, social media platforms, printed marketing materials, email campaigns, and other promotional channels.
Reasonable efforts will be made to respect client privacy. Personal contact information and other confidential information will never be shared without the client's consent. By engaging Gabrielle Rose Art, LLC, the client grants a non-exclusive, royalty-free license permitting such promotional use unless a written confidentiality or non-disclosure agreement has been executed by both parties before work begins.
Privacy & Data
All personal information is handled in accordance with the Gabrielle Rose Art Privacy Policy.
Agreement
By booking, purchasing, or commissioning work from Gabrielle Rose Art, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
